Introduction

These terms establish a binding agreement between you and SFR3 LLC governing your use of Blackbird (blackbird.sfr3.com) and related digital properties. By accessing this platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms of Service.

SFR3 LLC reserves the right to modify these terms at any time, with updates reflected in the “Last updated” date above. Continued use of the platform following revisions constitutes acceptance of changes.

Age and Jurisdiction Requirements

This platform is intended exclusively for users aged 18 and older. The information provided is not intended for distribution in jurisdictions where doing so would violate local laws or create registration requirements.

Intellectual Property Rights

All platform content, including source code, designs, text, and graphics, are either company-owned or properly licensed. Content and trademarks receive protection under copyright and trademark laws.

Users receive a limited license permitting personal, non-commercial access only. No part of the platform and no content or marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

User Representations and Warranties

By using this platform, you represent that:

• Registration information you provide is accurate and current
• You maintain legal capacity and comply with these terms
• You are not a minor in your jurisdiction
• You will not use automated access methods
• You will not violate any laws through platform usage

Providing false information permits account suspension or termination.

Prohibited Activities

Users agree not to engage in activities including:

• Systematically retrieving platform data to create databases without written permission
• Collecting user information for unsolicited communications
• Circumventing security features
• Deceiving users or company personnel
• Automated data collection or mining operations
• Uploading viruses or disruptive materials
• Reverse engineering platform software
• Harassing company employees

Activities inconsistent with applicable laws are prohibited.

Submissions

Any feedback, suggestions, or ideas provided to the company become its non-confidential property. SFR3 LLC shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

Term and Termination

SFR3 LLC reserves rights to deny access or delete accounts at any time, without warning, at our sole discretion, for any reason or no reason. Users cannot register new accounts under false names following termination.

Governing Law

These terms are governed by Delaware law, applicable to agreements made and to be entirely performed within the State of Delaware.

Dispute Resolution

Informal Negotiations: Parties must attempt informal resolution for at least 30 days before pursuing formal action.

Binding Arbitration: Disputes proceed through binding arbitration under American Arbitration Association rules, typically in San Francisco, California. Class action arbitration is prohibited. Disputes must commence within one (1) year after the cause of action arose.

Disclaimer

The platform is provided on an as-is and as-available basis. SFR3 LLC disclaims all warranties, including merchantability and fitness for particular purposes. SFR3 LLC assumes no liability for content inaccuracies, unauthorized access, service interruptions, or third-party products or services.

Limitations of Liability

In no event will SFR3 LLC, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages. Liability is limited to amounts paid to the company during the preceding six months.

Indemnification

Users agree to defend and indemnify SFR3 LLC against losses arising from their contributions, platform use, breach of terms, or violation of third-party rights, including intellectual property violations.

Electronic Communications

Users consent to electronic communications. All agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communication be in writing.
